Short answers on how a Bitcoin sale is taxed in India.
Bitcoin is a Virtual Digital Asset under Indian tax law. Profit from selling it is taxed at a flat 30%, plus a 4% cess on the tax and any surcharge that applies to your income. On top of that, 1% TDS is deducted from the sale value and counts towards your final tax bill.
30% of the profit, or 31.2% once the 4% cess is added. If you bought 0.5 BTC at ₹25,00,000 per BTC and sold at ₹32,00,000, the profit is ₹3,50,000. Tax is ₹1,05,000, or ₹1,09,200 with cess.
Yes. The buyer or the exchange deducts 1% of the sale value and deposits it against your PAN. It is tax paid in advance, so you claim it as credit when you file your return.
No profit tax is due on that sale. The loss cannot be set off against any other income, including gains on other crypto, and it cannot be carried forward to later years. TDS may still be deducted from the sale, and you can claim it as credit or a refund when you file.
No. India has no lower long-term rate for crypto. The 30% rate applies whether you held your Bitcoin for a day or for several years.
