Germany crypto tax rules

For private investors, selling crypto is a private sale under section 23 of the Income Tax Act. How long you held it decides whether the gain is taxed at all.

Private sales

Tax-free after 1 year

  • Hold for more than a year and the gain is tax-free. This applies however large the gain is.
  • Sold within a year, the gain is taxed as income. It is added to your other income and taxed at your personal rate, from 14% to 45%. There is no flat rate for crypto you hold directly.
  • Gains under €1,000 a year are tax-free. The limit covers all your private sales in a calendar year. At €1,000 or more the whole gain is taxed, not only the part above the limit.
  • Swapping and spending count as sales. Trading one crypto for another, or paying with it, is a sale of the first one. The crypto you receive starts a new one-year period.

Losses, rewards and surcharges

Solidarity surcharge 5.5%

  • Losses offset private sale gains only. A loss on crypto sold within a year can be set against gains from other private sales, not against your salary.
  • Staking and mining rewards are income. They are taxed at their value when you receive them, unless such income totals less than €256 in the year.
  • The solidarity surcharge is for higher incomes. It is 5.5% of income tax, charged only once your income tax is above €20,350, or €40,700 for couples, and phased in above that.
  • A change is planned. The federal government has said it wants to tax crypto gains whatever the holding period, with 2027 as the target. As of October 2026 this is not law.

2026 income tax rates

Marginal rates on taxable income for a single person. For couples assessed jointly each band is twice as wide.

RateTaxable income
0%Up to €12,348
14% to 24%€12,349 to €17,799
24% to 42%€17,800 to €69,878
42%€69,879 to €277,825
45%From €277,826

Figures are for the 2026 calendar year and for private investors. In the two middle bands the rate rises steadily with income. Trading as a business is taxed differently, and the one-year rule does not apply to it.

Frequently asked questions

Short answers on crypto tax in Germany and on how this calculator gets its numbers.

For private investors a crypto sale is a private sale. If you sell within one year of buying, the gain is added to your income and taxed at your personal income tax rate. If you sell after more than one year, the gain is tax-free.

It depends on your income. Take a single person with €50,000 of other taxable income who sells 0.5 BTC bought at €60,000 per BTC for €90,000 per BTC within a year, a gain of €15,000. Income tax rises from €10,548 to €16,205, so the sale costs €5,657 in tax, about 38% of the gain. Held for more than a year, the same sale costs nothing.

Yes, under the rules for 2026. The holding period is counted for each purchase, and it has to be more than one year. If you bought at different times, the units bought first are generally treated as sold first, wallet by wallet.

If your total gains from private sales in a calendar year are less than €1,000, they are tax-free. It is an exemption limit, not an allowance: at €1,000 or more, the whole gain is taxed. The calculator treats the trade you enter as your only private sale of the year.

It may be. The federal government has said it plans to treat crypto gains as capital income, which would make them taxable however long you held, and is aiming for 2027. As of October 2026 no law has been passed and the details are not settled, so the one-year rule still applies to 2026. Check the current position before you rely on it for later years.

Yes. Swapping is a sale of the crypto you give up, at the market value in euros of what you receive. If you held the first crypto for a year or less, the gain is taxable. The crypto you receive starts a new one-year holding period.

A loss on crypto sold within a year can be set against gains from other private sales in the same year. It cannot reduce other income such as your salary. Unused losses can be carried to other years, again only against private sale gains. A loss on crypto held for more than a year does not count.

Rewards are income when you receive them, at their market value in euros. They are tax-free if this kind of income totals less than €256 in the year. That value then becomes your cost when you later sell the rewarded coins.

The solidarity surcharge is 5.5% of your income tax, but only if your income tax for the year is above €20,350, or €40,700 for couples assessed jointly. Just above that it is phased in. Church tax is 8% or 9% of your income tax, depending on the federal state, and only church members pay it.

It multiplies your buy and sell prices by the quantity and subtracts fees to get the gain. If you held for more than a year, or the gain is under €1,000, the tax is €0. Otherwise it places the gain on top of your other taxable income, applies the 2026 income tax formula, and adds the solidarity surcharge and any church tax.
